Terms of Service

These Terms of Service ('Terms') constitute a legally binding agreement between you (or the organisation you represent) and NexoCyber Networks S.L. ('SkyDefended', 'we', 'us'). If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree to these Terms, do not use the services.

SkyDefended provides cloud-based security SaaS products including Identity Hub LaaS, Process Mining for Security, and associated tools. Services are provided on a subscription basis and are described in the applicable Order Form or product documentation. We reserve the right to modify, suspend or discontinue any service with reasonable notice.

Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

Multi-factor authentication

MFA is mandatory for all administrative accounts. You agree to enrol in MFA upon first login and to keep your authenticator device secure.

Acceptable use

You agree not to use the services to conduct security attacks, transmit malware, circumvent access controls, or violate applicable law. Violations may result in immediate account suspension without refund.

All intellectual property rights in the services, including software, documentation, branding and interfaces, are owned by NexoCyber Networks S.L. or its licensors. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the services for your internal business purposes. You may not copy, modify, reverse-engineer or distribute any part of the services without prior written consent.

You retain all ownership and intellectual property rights in the data you submit to the services ('Customer Data'). You grant SkyDefended a limited licence to process Customer Data solely to provide the services. We do not use Customer Data to train AI models or for any purpose beyond service delivery and security monitoring.

Disclaimer

The services are provided 'as is' and 'as available'. SkyDefended does not warrant that the services will be error-free or uninterrupted, though we commit to the SLAs set out in the applicable Order Form.

Limitation

To the maximum extent permitted by applicable law, SkyDefended's aggregate liability for any claims arising from or related to these Terms shall not exceed the fees paid by you in the 12 months preceding the claim. We shall not be liable for indirect, incidental, special or consequential damages.

These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain, without prejudice to mandatory consumer protections applicable under your local law within the EU.

We may modify these Terms at any time. Material changes will be communicated via email at least 30 days before the effective date. Your continued use of the services after that date constitutes acceptance of the revised Terms. If you do not accept the changes, you may terminate your subscription before the effective date.
